Welcome to thedailyriff.com* (the "Site"), a service of The Daily Riff*, Inc ("TDR" or "We").  This is a legally binding Agreement between you and TDR. Please read it before continuing to use the Site.

1. Your Access to thedailyriff.com; Acceptance of Terms of Use:
By accessing and using the Site, you acknowledge that you have read, understand, and agree to be bound by and comply with the Terms of Service. IF YOU DO NOT AGREE WITH THE TERMS OF USE AGREEMENT, DO NOT ACCESS AND USE THE SITE. The Terms may be modified without prior notice at anytime. Your continued use of the Site constitutes that you agree with the modified terms.
2. Intellectual Property:
The Site is protected by copyright, trademark, and other intellectual property laws and international treaties. All of the content contained within and on the Site is the sole property of TDR and its third party suppliers, if applicable. Except as permitted by law or by obtaining TDR's prior written permission, you may not copy, redistribute, publish, retransmit, transfer, modify or create derivative works, or in any way commercially exploit, any content on the Site, in whole or in part. Furthermore, you may not change or delete trademark legends or copyright notices.
3. Copyrights and Trademarks:
We respect the copyright and intellectual property rights of others. TDR reserves the right to remove content that appears to infringe the copyright or other intellectual property rights of others. 5. User Submissions
Users must be over the age of thirteen to post Submissions to the Site.
You may submit, post or transmit comments and messages ("Submissions") to blogs, articles or other public areas on the Site and you agree that these Submissions are sent voluntarily by you with full knowledge that the Submissions will not be kept in confidence between you and TDR and/or the Site. You also agree that by making the Submission(s) you attest that you have obtained permission from any necessary person or entity prior to making your submission to the Site. For instance if your Submission refers to a school, teacher, school district, student, principal or any other person, you agree to obtain permission from that person or if that person is a minor, from that minor's parent or legal guardian prior to making your Submission to the Site. You acknowledge that if your Submission violates any of TDR's or a third party's intellectual property, TDR reserves the right to remove the offending material.
Submissions are not necessarily reviewed by TDR prior to being posted and may not reflect the opinions or views of TDR. TDR reserves the right to edit, restrict or remove inaccurate, offensive, inappropriate, or unlawful material submitted by any user, for any reason at any time without notice.
If your Submission involves a third party website link,  please carefully read the Terms and Conditions of these websites, because TDR is not liable for activity on third party websites.
Although TDR may from time to time, and at its own discretion, monitor Submissions, TDR is not responsible for the content of user Submissions and has no obligation to edit or remove inappropriate Submissions.
Users submitting comments agree to frame their comments to the subject matter of the article or blog that they are commenting on. You also agree that other users may access, view or copy your material for their own personal use and that you will not limit such use by another user.
TDR may invite users to submit articles and also welcomes story ideas that further the purpose the thedailyriff.com. If you submit an article or other submission, or if you send us your creative ideas including materials you may upload, you will agree to grant to TDR a worldwide, royalty-free, perpetual, irrevocable, nonexclusive right and license to use, including without limitation the right to reproduce, modify, adapt, publish, translate, and distribute such materials throughout the world and/or to incorporate it in other works in any form, media, or technology now known or hereafter developed, for the full term of any copyright, or trademark, that may exist in such material for any purpose that TDR chooses, without any compensation, credit, or notice to the sender whatsoever. The sender waives all so-called moral rights in all Submissions. The sender further waives the right to make any claims against TDR relating to unsolicited submissions, including, but not limited to, unfair competition, breach of implied contract, and/or breach of confidentiality.
6. Prohibited Conduct:
Your use of the Site, including without limitation any comments, messages, or any posted content, may only be for lawful purposes and in full compliance with all applicable local, state, national and international laws. Unacceptable conduct includes, without limitation, using the Site to:
* Defame, abuse, harass, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity) of others;

* Gain unauthorized access to the Site, or any account, computer system or network connected to this Site, by means such as hacking, password mining or other illicit means,

Under no circumstances shall TDR, its affiliates, partners, officers, directors, employees or agents be liable for any loss, damage or harm caused by your reliance on information obtained through the Site. TDR has no control over and cannot monitor the content of the websites and information you will have access to by following a third party link to another website. TDR is not responsible for the content or reliability of the websites, links, resources, and information you will have access to from other sites. TDR shall not be responsible or liable directly or indirectly, for any damages or loss caused or alleged to be caused by or in connection with your use of or reliance on any such content, goods or services available on or through any such third part website or resource.
9. Disclaimer of Warranties:
TDR disclaims any and all responsibility and/or liability for the accuracy, completeness, legality, reliability, operability and availability of any content, information, services, or sites accessible on or through the Site. In addition, TDR disclaims any responsibility for the deletion, failure to store, failure to deliver or untimely delivery of any information or material. TDR disclaims any and all harm resulting from downloading or accessing any information or material on or through the Site and assumes no liability or responsibility for any errors or omissions in such content.

11. Indemnity:

12. Your Interaction with Advertisers:
Your interaction in any way with or participation in promotions of advertisers or merchants found on or through the Site, including payment and delivery of related goods and services, and any other terms, conditions, warranties or representations associated with such interactions, are solely between you and the advertiser or merchant. TDR will not be liable in any way for any loss, damage or injury you may incur as a result of your interaction with such advertisers or merchant. TDR expressly disclaims any endorsement of any businesses, products or services provided by third parties on or through the Site.
13. Termination of Service and Access:
TDR and the Site reserves the right to terminate your access to the Site at any time for any reason. It will be in TDR's sole discretion to make a decision to terminate your access and you agree that TDR shall not be liable to you for the termination of your access to the Site.
14. Miscellaneous:
If any provision of this Terms of Use Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, such provision shall be deemed stricken, and the remainder of the Terms of Use Agreement shall continue in full force and effect. Any waiver by TDR of the performance or satisfaction of any provision hereof will not be considered to be a waiver of any other similar or dissimilar covenant or condition hereunder, nor will it be considered a continuing waiver of the same provision in the future. TDR may amend, alter or modify these Terms of Use at any time with or without notice. TDR reserves the right to assign our rights and delegate our duties under these Terms of Use either in whole or in part at any time, in our sole discretion, and without your consent. The laws of the State of South Carolina, exclusive of the choice of law provisions, shall govern any claim relating to this Site or your use of this Site. Any legal action or proceeding concerning the Site or TDR shall be  brought exclusively in a federal or state court of competent jurisdiction located in Charleston County, South Carolina.
